1. Provider and scope

These terms apply between you and the provider of Haru Harbor (“Haru Harbor: Cozy Farm Village”):

  • Alex Viktor Heinrich, c/o Block Services, Stuttgarter Str. 106, 70736 Fellbach, Germany
  • Email: [email protected]
  • Phone: +49 163 1603720

They govern the use of the game Haru Harbor and its online features. By downloading or using the game you enter into a user agreement with us under these terms. Your contract with the App Store or Google Play is additionally governed by the terms of that store.

2. What Haru Harbor is

Haru Harbor is a farming and village game played with others: you build up a village by the water, trade at the morning market, visit friends and play in village communities. The game is free to play. If you like, you can buy pearls, the season pass, decoration sets and packs; the game shows what a purchase includes before you buy. Ads are only videos you start yourself.

Your progress is kept on our servers. The market, friends, village communities and purchases need an internet connection; harvesting, crafting and decorating also work without one.

3. Your account

On the first start the game creates an account for you. Link it with Apple, Google, Game Center or Google Play Games so you can bring your village to another device; without a link, an account may be lost together with the device. Keep your sign-in with these providers secret.

Your account is personal and not transferable. Selling, buying or swapping accounts is not allowed.

4. Licence

You receive the non-exclusive, non-transferable right to use Haru Harbor on devices that you own or control, within the usage rules of your store. The software, characters, images, music, sounds and texts remain our property or that of our licensors. You may not extract them from the game, pass them on or use them outside the game. Statutory rights, for example under Sections 69d and 69e of the German Copyright Act, remain unaffected.

5. In-game purchases

On offer are pearls, the season pass as a purchase for the current month, decoration sets, packs and “Ad-free” as a one-time purchase; some offers are available only for a certain time, for example during a festival, and the game shows when they end. There are currently no subscriptions. Nothing random is sold for real money. The price and content are shown in the game and in the store before you buy; every player in a country sees the same prices and offers, but the price may differ by country.

The purchase is handled by your store: in the European Economic Area, Apple Distribution International Ltd. for the App Store and Google Commerce Limited for Google Play. You pay through your account with the store. Payment, invoicing and refunds are governed by the store’s terms.

Purchases are credited to your account on our server as soon as the store confirms them. If that takes longer, the game credits them by itself; you can also restore them under Settings → Account. If the store refunds a purchase, we take back the pearls of that purchase. If your balance is not enough for that, you can spend pearls again only once it is positive again; we do not take back items.

6. Right of withdrawal

As a consumer you generally have a statutory right to withdraw from purchases in the store within 14 days. You exercise it towards the store that handled the purchase; there you also find the withdrawal information and the cases in which the right ends early, for example when the supply of digital content begins with your consent. With Apple this is done at reportaproblem.apple.com and with Google Play through the refund request in your Google Play account.

7. Mon, pearls and in-game content

Mon, pearls, goods, decorations and other content exist only in the game. They have no monetary value, are not paid out and can be passed on only as the game allows, for example as a gift between friends within the game’s limits.

Purchased pearls never lose value. From an amount you can set, pearls are spent only after a confirmation, and you can undo the spending for a few seconds afterwards. We announce changes to prices or rules in advance. We may change game rules, rewards and values for the future, for example to keep the game balanced; this does not take away anything you have bought.

8. Living together in the village

Haru Harbor lives from a friendly community. Not allowed are:

  • insulting, threatening, harassing or excluding others, also through names, descriptions and messages,
  • sharing content that is unlawful, sexual, glorifies violence or is unsuitable for children,
  • asking for or sharing personal data, your own or anyone else’s, or approaching children and teenagers to meet them,
  • trading game content for real money, selling accounts or advertising either,
  • manipulating the game, the market or competitions with programs, bots, several accounts or bugs in the game,
  • attacking or overloading our servers or circumventing protective measures.

Report violations in the game with “Report”. Depending on how serious they are, we may hide messages, mute you for a while, block the chat for you or suspend your account; we tell you the reason for a suspension, and you can write to us. We take your interests and those of the other players into account.

9. Children and teenagers

Haru Harbor is made for all ages. Anyone who is not yet of age uses the game with the agreement of their parents or guardians; this applies in particular to purchases. Free chat is open only from age 13; younger players use ready-made messages. So please give your age correctly. Purchases can be restricted in the device settings: on iPhone through Screen Time, on Android through Google Play and Family Link.

10. Availability, updates and changes

We try to keep the online features available at all times. Maintenance, faults and events beyond our control may interrupt them for a while; without a connection you keep playing with the features that work offline.

We provide the updates that are needed for Haru Harbor to remain in conformity with the contract and announce them through the store. Install them promptly. We are not liable for defects caused solely by the fact that an update we provided was not installed (Section 327f of the German Civil Code).

We may change Haru Harbor where there is a valid reason, such as new requirements from Apple or Google, new operating systems, security, a change in the law or the further development of the game. This costs you nothing. If a change impairs the use of something you bought more than insignificantly, we inform you beforehand; you can then end the contract free of charge within 30 days (Section 327r of the German Civil Code). If we discontinue Haru Harbor, we announce this with reasonable notice.

11. Deleting your account and ending the contract

You can end the contract at any time by deleting your account in the game under Settings → Account → Delete account. After a period of 14 days in which you can cancel, we delete the account and progress. Purchased pearls and items expire with it; this does not include a refund, and your statutory rights remain unaffected.

We may end the contract for good cause, for example for serious or repeated violations of section 8.

12. Defects and feedback

The statutory rights for defects in digital products apply (Sections 327 et seq. of the German Civil Code). The easiest way to report a problem is in the game under Settings → Help → Report a problem, or by email.

We may use suggestions and hints you send us to improve Haru Harbor. This creates no claim to their implementation or to payment.

13. Liability

We are liable without limit for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee.

For slight negligence we are liable only if we breach an essential duty, that is, a duty whose fulfilment makes the contract possible in the first place and on which you may rely. Liability is then limited to the damage that is typical and foreseeable for a contract of this kind. Otherwise liability for slight negligence is excluded. Other players are responsible for what they write themselves.

14. Apple App Store

If you downloaded Haru Harbor from Apple’s App Store, the following applies in addition:

  • These terms are concluded between you and us only, not with Apple. We alone, not Apple, are responsible for Haru Harbor and its content.
  • Your licence is non-transferable and covers Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Other accounts may use Haru Harbor through Family Sharing or volume purchasing.
  • We alone provide maintenance and support. Apple has no obligation to do so.
  • We alone are responsible for any warranty. If Haru Harbor fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price to you. Beyond that, to the maximum extent permitted by law, Apple has no warranty obligation for Haru Harbor.
  • Claims by you or third parties relating to Haru Harbor are addressed to us, not to Apple. This includes product liability claims, claims that Haru Harbor fails to conform to a legal or regulatory requirement, and claims under consumer protection or privacy law.
  • If a third party claims that Haru Harbor infringes its intellectual property rights, we alone, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
  • You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that the U.S. Government has designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • When using Haru Harbor you comply with the third-party terms that apply to you, for example those of your mobile contract.
  • Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept the terms, Apple has the right to enforce them against you as a third-party beneficiary.
  • Questions, complaints and claims about Haru Harbor go to the address, email address or phone number in section 1.

As long as no custom licence for Haru Harbor is on file in the App Store, Apple’s standard end-user licence applies to the game on Apple devices alongside these terms: www.apple.com/legal/internet-services/itunes/dev/stdeula

15. Google Play

If you downloaded Haru Harbor from Google Play, purchase and payment are additionally governed by the Google Play Terms of Service.

16. Changes to these terms

We may adapt these terms for the future where there is an objective reason, such as new features, new requirements from the stores or a change in the law. The current version is on this page with its date; we announce material changes in the game beforehand. Changes that shift the balance between what you get and what you pay to your disadvantage apply only with your consent.

17. Law, dispute resolution and language

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you live in another country as a consumer, you keep the protection of the mandatory provisions of the country where you habitually reside.

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

If the language versions differ, the German version applies. Should a provision be invalid, the others remain in force.
